Former Playboy model and model-to-the-stars Tay Anderson claims the website NYDailyNews.com defamed her by saying she was sexually assaulted by former Penn State University football coach Jerry Sandusky.
Anderson’s lawyer, Lori K. Alderman, filed the defamation lawsuit against NYDailyNews.com and website operator Darryl Jones on Monday in Pennsylvania’s court of common pleas in Philadelphia.
NYDailyNews.com ran several articles in early 2012 that said Anderson had been sexually assaulted at an Atlantic City, New Jersey, nightclub in 2009 by a then-unidentified man.
The stories ran under the headline “Tay Anderson, Playboy model, says she was sexually assaulted in party by accuser of Jerry Sandusky” and under the headline “Tay Anderson, model, tells authorities she was sex assaulted by Sandusky”
Anderson was never sexually assaulted by Sandusky.
NYDailyNews.com asked Anderson to comment on the stories, which she refused, according to the lawsuit.
But the site went on to repeat the allegations in a few more stories, followed by an interview in March 2012 with Anderson’s then-boyfriend, Darryl Jones, who disputed the allegations.
In one of the published stories, Anderson’s former boyfriend said she left his home “in tears” because she was leaving him.
She never left, the lawsuit claims.
After Anderson dropped Jones, the site continued the defamatory articles, and published a story in June 2012 saying that Anderson had been involuntarily committed to a mental hospital, according to the lawsuit.
Anderson sued Jones for defamation, and in a New York federal court, Jones and NJ-DG Media Corp. were ordered in April 2014 to pay Anderson $500,000. NJ-DG Media publishes the NYDailyNews.com website.
NJ-DG Media has appealed the decision to the Third Circuit Court of Appeals, and the appellate court is expected to hear arguments over the case in August.
Anderson’s lawsuit against NYDailyNews.com also names blogger Darryl Jones, CEO and publisher Lanny Davis and Lanny Davis, the law firm’s director of crisis management and research, as defendants.
A spokesman for the NYDailyNews.com did not immediately respond to CNN’s request for comment.
